The trademark “Hwy 111 Magazine” was voluntarily surrendered on July 8, 2005 by the
registrant Stuart Weiner, publisher of the magazine.

The surrender followed a petition to cancel the trademark registration, which was filed in the
Trademark Trial and Appeals Board of the United States Patent & Trademark Office on
Christmas Eve 2004 by the plaintiff, Lance Cory Frank of Palm Canyon Advertising, owner
of the website HWY111.COM.

The defendant had agreed to mediation of the dispute, but surrendered and withdrew soon
after an opposition was filed by the plaintiff to Hwy 111 Magazine L.L.C’s application to
register the mark “111 Magazine.”
