What is a trademark?

Lance Frank (D.B.A. Palm Canyon Advertising) had been using the
HWY111.COM® brand since 1997.  Litigation was initiated when, five
years later, viscous disparagement to the brand and Frank resulted
from  Stuart Weiner et al's use, and informal efforts to resolve the matter
had failed

This trademark was the subject of three successful litigations. The first
resulted in Weiner's surrender of the Hwy 111 Magazine mark. The
second in his abandonment of the application for the 111 Magazine mark.
After a settlement agreement was signed, the third was a suit for anticipated
breach of contract, bad faith, and fraud when Weiner publicly announced
his intention to use One Eleven Magazine as a mark. As a result of the
litigation, the magazine now calls itself Season In The Sun. .
